1. Who we are

Stay-Put Cargo Solutions (“Stay-Put”, “we”, “us”, “our”) is the responsible party for the personal information described in this policy, as that term is defined in the Protection of Personal Information Act 4 of 2013 (POPIA).

2. What this policy covers

This policy explains what personal information we collect through stayput.co.za, why we collect it, who we share it with, how long we keep it and what rights you have.

This website is an information and enquiry site. We do not sell products online. We do not collect payment card details, billing addresses or delivery addresses through this website, and the site does not offer customer accounts or logins. If you place an order with us directly by phone or email, that transaction is handled outside this website.

3. What information we collect

Information you give us

When you complete an enquiry form on the site, or contact us by email or telephone, we collect the information you choose to give us. This usually includes your name, email address, telephone number, company name and the content of your message or enquiry.

Information collected automatically

Like most websites, our servers and the tools we use record technical information when you visit. This may include your IP address, browser type and version, device type, operating system, the pages you viewed, the date and time of your visit, and the website or search you arrived from. Some of this is collected through cookies and similar technologies, which are explained in section 8.

What we do not collect

We do not knowingly collect personal information from children under the age of 18 through this website. We do not collect special personal information, such as information about your health, religious beliefs, race or biometrics, through this website.

4. Why we use your information

We use personal information only for the purposes below, and only where POPIA allows it:

  • To respond to your enquiry and provide quotations. This is necessary to take steps at your request before entering into a contract with you, and is in our legitimate interests as a business.
  • To supply products and provide after-sales support. Where you become a customer, this is necessary to perform our contract with you.
  • To keep business records. Tax, company and consumer legislation requires us to retain certain records of enquiries and transactions.
  • To send you marketing about our products. We do this only where you have given us consent, or where you are an existing customer and the marketing relates to similar products. You can opt out at any time, at no cost, using the unsubscribe link in any message or by emailing us.
  • To keep the website secure and working. Spam filtering, error logging and abuse prevention are in our legitimate interests.
  • To understand how visitors use the site. We do this through analytics, and only where you have accepted analytics cookies.

We will not use your information for a new purpose that is incompatible with the purpose it was collected for, without telling you first.

5. Who we share your information with

We do not sell your personal information and we do not share it with third parties for their own marketing.

We do share it with service providers who process it on our behalf, which POPIA calls operators. They may only use it to provide their service to us, and they are required to keep it confidential and secure. These currently include:

  • our website hosting provider, [HOSTING PROVIDER]

  • [our form security and spam filtering tools, e.g. Google reCAPTCHA]
  • [our email marketing platform, if applicable]
  • our professional advisers, such as accountants and attorneys, where necessary
  • courier and logistics providers, where you have placed an order with us and goods must be delivered

We may also disclose personal information where we are required to do so by law, by a court order, or by a regulator, or where it is necessary to establish, exercise or defend a legal claim.

6. Information sent outside South Africa

Some of the service providers listed above store or process information on servers outside South Africa, [including in the United States and the European Union]. Where this happens, we take the steps required by section 72 of POPIA to ensure that the recipient is subject to a law, binding corporate rules or a binding agreement that provides a level of protection substantially similar to POPIA.

7. How long we keep your information

  • Enquiries and general correspondence: [24] months from our last contact with you, unless you become a customer.
  • Customer and transaction records: [5] years, or longer where tax, company or consumer legislation requires it.
  • Marketing list entries: until you unsubscribe. We then keep a minimal suppression record so that we do not contact you again by mistake.
  • Website analytics and server logs: [14] months.

We previously operated an online store. Records created through that store are kept only for as long as the periods above allow, and are securely deleted or destroyed after that.

8. Cookies

Cookies are small text files placed on your device when you visit a website. We use:

  • Strictly necessary cookies, which make the site work and keep it secure. These cannot be switched off.
  • Analytics cookies, which help us understand how the site is used so we can improve it. [These are only set if you accept them.]

9. How we protect your information

We take reasonable technical and organisational measures to protect personal information against loss, damage and unauthorised access. These include encrypted connections to our website, access controls, restricting access to staff who need it, and keeping our software up to date.

No method of transmitting or storing information is completely secure, and we cannot guarantee absolute security. If a security compromise affects your personal information, we will notify you and the Information Regulator as required by section 22 of POPIA.

10. Your rights

Under POPIA you have the right to:

  • ask us to confirm whether we hold personal information about you, and to request a record of it
  • ask us to correct or delete personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully
  • object, on reasonable grounds, to us processing your information
  • withdraw your consent, where we rely on consent, without affecting processing that already took place
  • opt out of direct marketing at any time
  • lodge a complaint with the Information Regulator

To exercise any of these rights, email us at info@stayput.co.za. Requests for access to, or correction or deletion of, your personal information must be made on the prescribed forms under the POPIA regulations. We will send you the correct form on request, and they are also available on the Information Regulator’s website. We may need to verify your identity before acting on a request, and a prescribed fee may apply to access requests. We will respond within the period prescribed by law and, where no period is prescribed, within a reasonable time.

13. Complaints to the Information Regulator

If you believe we have not handled your personal information properly, please contact us first so that we can try to resolve it. You also have the right to complain directly to the Information Regulator:

14. Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last changed. Please check back occasionally, and note that continued use of the site after a change means you accept the updated policy.
